Booking Conditions

 

1. GENERAL

Tuscan Views Ltd with registered office at Pantiles Chambers - 85 High Street - Tunbridge Wells - Kent TN1 1XP – England, in these booking conditions is referred to as TV. The person in whose name the booking is made is referred to as client or party leader
 

2. INITIAL RESERVATION

When you place an initial reservation TV will hold the property for you for 48 hours until we receive the booking form signed and filled with all your details by fax or e-mail. At the time we receive the fax or e-mail we will make a provisional booking for you and hold the property for 3 wotking days to give you the time to pay the deposit or the full payment of rental charge (depending on the time of your booking. If no payments is received at the end of the 3 working days the property will be considered available for other clients.
 

3. BOOKING FORM

When we receive the completed and signed booking form and the deposit or full payment of rental charge we will confirm your reservation. Until that time no contract or agreement will be considered to exist between you and TV, therefore TV has no obligations to the client.
 

4. THE PARTY LEADER

The person who holds the booking is the party leader and will be responsible for the rental. All correspondences and invoices will be sent to the party leader at the address specified on the booking form.
 

5. PAYMENTS

A non-returnable deposit of 30% is payable at the time of booking; the balance is required no later than 9 weeks before the first day of the rental period. If booking less than 9 weeks before the first day of the rental period please send the full amount together with the completed and signed booking form.
 

6. LETTING PERIOD

The minimum letting period for each property is 1 week from Saturday to Saturday, unless otherwise specified.
 

7. ARRIVALS

Clients are expected to arrive at the property between 4:00 and 7:00pm, unless otherwise specified. Clients must ensure that their flight comply with these times, taking into account driving time to/from airports. However if clients need to arrive at a different time they must notify TV well in advance in order to make arrangements with the owner or his representative, but they may not be available to permit entry. If for any reason a delay should occur, every effort should be made to contact the owner or his representative. Upon arrival, clients should inspect the property with the owner or his representative and pay him a cautionary deposit as stated on each property description. This deposit will be refunded, less any money deducted for damages, on departure.
 

8. DEPARTURES

Clients are expected to leave the property at 10am on the final day of the rental period. The owner or his representative will arrive at the property at 9am to inspect the property. Any extra services and/or heating, telephone bills must be paid to him in Euro. Should you leave before 10am you must notify the owner or his representative at your arrival in order to arrange for a different time for the property inspection.
 

9. GROUP SIZE AND COMPOSITION

Only persons named on the Booking Form may occupy the property. Clients must notify TV in writing of any changes before the beginning of the rental period. Children of 2 and over are considered in the maximum occupancy.
 

10. VOUCHER PACK

The voucher pack will be sent to the client when the balance and the completed and signed booking form have been received. The voucher pack consist of: accommodation voucher, directions to the property, useful phone numbers, contact details of the owner or his/her representative.
 

11. PROPERTY DESCRIPTION

We personally visit each property to provide accurate property descriptions. The details are made in good faith on the basis of our personal visit and the information given by the property owner, however TV accept no responsibility for their accuracy and/or any modifications made by the owner without our knowledge and/or for construction or alteration of the area surrounding the property.
 

12. PHOTOGRAPHS

Photographs are intended to give a general idea of the property rather than details. TV accept no liability for any change to the villa and any aspects of the surrounding land which may have changed since the photographs were taken. We will do our best to keep photographs updated.
 

13. CHILDREN’S SAFETY AND EQUIPMENT

Clients with babies and small children should check with TV if children’s equipment is available at the selected property. These may not conform with safety standards and are used at client’s own risk. We recommend whenever possible that clients bring their own travel cots. Bedding for cots and cribs is not supplied.
 

14. SWIMMING POOLS

Swimming pool are open from May to September, unless otherwise specified. Use of the swimming pool is strictly at the client’s own risk and children should be supervised at all times. Swimming pool are not heated unless specified in the property description. TV accepts no responsibility if the swimming pool cannot be used due to weather conditions or reasons beyond our control
 

15. HOUSEHOLD AMENITIES

Properties are supplied with bed and bath linen and table ware for the number of guests indicated in the booking form. Bed and bath linen are changed weekly. Charges for heating or telephone are based on consumption and must be paid locally to the owner or his representative at the end of the rental period. The owner or his representative will do his best to be sure that water, gas, electricity or telephone services are available at any time. We cannot accept responsibility for non-delivery due to circumstances beyond our control.
 

16. PARTY BEHAVIOUR

The party leader is responsible for leaving the property rented with all its furniture and effects clean and in good condition, and undertakes to inform the owner or his representative of any damage to the accommodation or its contents and to pay for any damage or missing items or for any extra cleaning made necessary by the property being left in a dirty condition. These are private homes; please respect the trust which owners have afforded to you and look after the property while you are there. Should the party behave in a manner that is not acceptable, the owner or his representative has the right to ask you to vacate the property, TV will have no responsibility or obligations to pay you compensations or to cover any costs that you will have to pay as a result of having to make new arrangements. No camping is permitted on the property ground.
 

17. ELECTRONIC SIGNATURE

Both parties accept executed documents by facsimile or e-mails.
 

18. TRAVEL INSURANCE AND PASSPORTS

By signing the booking form clients declare that they hold a valid travel insurance policy. It is clients responsibility to be in possession of a valid passport and of any necessary visas.
 

19. PETS.

No pets are allowed unless specified in the description of the property.
 

20. PRICES

Prices are in Euro and the rental period is weekly, unless otherwise specified. We will advise of the prevailing exchange rate of the day in GBP sterling or US dollars at the time of booking. Properties are let fully furnished and equipped. Some properties have different conditions for letting which are indicated in the property details. We are entitled to vary the advertised selling price to reflect any change in exchange rates or increase of every other cost of services included in the booking. Where price increases or decreases are known to us before you book, we shall inform you of the new price before you book. Where increases become effective after you have booked we reserve the right to recover these and will send you a supplementary invoice. We will not surcharge you within 30 days of your departure. Any surcharge will not exceed 10% of the total price In return for this guarantee there will be no refund in the event of favourable currency movement.
 

21. METHODS OF PAYMENTS

Payments are accepted in English Pounds only (we will advise of the exchange rate of the day the payment is due) and may be made by cheque or bank transfer/wire.
 

22. ABANDONMENT OF YOUR HOLIDAY

If for any reason which is beyond our control you choose, in the course of your holiday, to abandon the arrangements made by us on your behalf, unless TV is at fault and has been afforded the opportunity to rectify the situation, we accepts no liability and no refunds will be made for the services you choose not to take.
 

23. ALTERATIONS AND CANCELLATIONS BY TV

If the property that the client has booked become unavailable for reason beyond TV’s control or due to Force Major (including war or threat of war, riot, civil strife, industrial disputes, terrorist activity, natural disaster, fire or adverse weather conditions) we reserve the right to offer a similar property to the client where is possible or to refund the amount paid by the client If the alternative holiday accommodation is not acceptable and shall be under no other liability.
If at the due date no balance payment has been received TV has the right to cancel the booking and the client will loose the deposit as per cancellation fees (No 25).
 

24. ALTERATIONS AND CANCELLATIONS BY THE CLIENT

Once the booking is confirmed any alterations should be made in writing by the client. A £ 25 amendment fee per person will be charged for any change made to the original booking. If the client decide to transfer the booking to another person should inform TV in writing and the new client must supply TV with a completed and signed booking form. £ 40 per person will be charged to the new client to cover expenses. No alteration is accepted less than 30 days before departure. In the event that a client choose to modify the arrangements after his arrival at the property he will break his contract with TV, therefore we do not accept any liability for loss, damage or additional expenses and no refunds will be made for services that have not been utilised.
 

25. CANCELLATION FEES

All cancellations by the party leader must be made in writing. Cancellation applies from the date of receipt of cancellation notification and we cannot be responsible if a letter is received within the cancellation period with no proof of posting. Cancellation charges are as follows:
More than 9 weeks before departure -loss of deposit
6-9 weeks before departure - 50% of holiday cost
6 weeks or less before departure -100% of holiday cost.
 

26. RESPONSIBILITY

The signing of the Booking Form implies acquaintance with these booking conditions and comprises their acceptance without reservation or exception by the person signing and all those people named on the Booking Form. We act as booking agents on behalf of named owners of the properties featured on our web site and as such your rental contract is with the relevant owner. We do not have any obligation to compensate you for any personal injury, death, loss or damage of whatever nature suffered by you (or by other member of your party) save to the extent caused by our own negligence.
